Pursuant to an Order of the Court of Chancery of the State of Delaware, in and for Sussex County, in proceedings to partition to the real property of Rick T. Bednarik and Colleen H. Bednarik, I will expose, by way of public vendue or auction, on the premises on Concord Pond Road, 121 feet southwest of Road 481 with an address of 817 Concord Road, Seaford, Delaware 19973 together with any improvements thereon, which is more particularly described in a deed dated August 16, 2000, of record in the Office of the Recorder of Deeds, at Georgetown, Delaware in Deed Book 2514, Page 032, parcel number 14.00 map 1.12 district 1-32.

TERMS OF SALE
Twenty percent (20%) of the purchase price must be paid by the Buyer at the time of the sale. The balance to be paid to John E. Tarburton, Esquire, Trustee at the Law Offices of Sergovic & Ellis, P.A. 9 North Front Street, Georgetown, Delaware 19947, on or before July 6, 2005. The twenty percent (20%) down payment made on the day of the sale will be treated as part of the purchase price if all the terms of the sale are met; otherwise, it will be forfeited for non-compliance and treated as liquidated damages. Buyer to pay the cost of the Deed and one half (1/2) of all applicable transfer taxes (Sale subject to confirmation on Friday, July 8, 2005 at 10:00 A.M.).
NOTICE TO CREDITORS
NOTICE in compliance with Delaware law is hereby given that the shares of interest Rick T. Elliott and Colleen Bednarik in the above described parcel of land will be sold as set forth above and all persons having or claiming any liens or encumberances against the above named share holders, are hereby notified to appear in the Court of Chancery, in and for Sussex County and the State of Delaware, at the Sussex County Chancery Building, The Circle, Georgetown, Delaware, on July 8, 2005 at 9:00 a.m., the return day of the sale, and make proof of said claim and the amount due thereon.
