Pursuant to an Order of the Court of Chancery of the State of Delaware, in and for Sussex County, in proceedings to partition the real property of Nicholas D. DelleDonne and Lena Fiorelli, I will expose, by way of public vendue or auction on the premises, in Indian River Hundred, Sussex County, lot 3, Holly Oak, with a mailing address of 22147 Holly Oak Lane, Lewes, DE 19958, as shown on Plot Book 13, Page 60, with all improvements thereon, and more particularly described in a deed dated April 30, 1990, of record in the Office of the Recorder of Deeds, at Georgetown, Delaware, in Deed Book 1716, Page 336, parcel number 461.00, map 11.00, district 2-34.

TERMS OF SALE


Twenty percent (20%) of the purchase price must be paid by the Buyer on the day of the sale. The balance, together with an amount sufficient to cover costs and expenses of sale, in certified funds, is to be paid to Richard E. Berl, Jr., Esquire, Trustee, at the Law Offices of Smith O’Donnell Feinberg & Berl, LLP, 406 S. Bedford Street, Georgetown, Delaware, on or before May 18, 2007. The twenty percent (20%) down payment made on the day of sale will be treated as part of the purchase price if all the terms of the sale are met; otherwise, it will be forfeited for non-compliance and treated as liquidated damages. Buyer to pay the cost of the Deed and one half (½) of all applicable transfer taxes (Sale subject to confirmation on Friday, May 25, 2007, at 9:30 A.M.).


NOTICE TO CREDITORS


NOTICE in compliance with Delaware law is hereby given that the shares of interest of Nicholas D. DelleDonne and Lena Fiorelli in the above described parcels of land will be sold as set forth above and all persons having or claiming any liens or encumbrances against the above named share holders, are hereby notified to appear in the Court of Chancery, in and for Sussex County and the State of Delaware, at the Sussex County Court of Chancery, The Circle, Georgetown, Delaware, on May 25, 2007, at 9:30 A.M., the return day of the sale, and make proof of said claim and the amount due thereon.
